Who hasn’t thought about owing or starting a franchise? Most business owners dream of seeing their brand spread worldwide with thousands of franchisees sending in royalty checks every month. Many individuals, probably 95%, have dreamed of being their own boss and looked at franchises at some point in their career.

Michael is a widely respected franchise attorney in Atlanta who has extensive experience having been an Assistant Attorney General for the State of Georgia as well as Special Project Coordinator for the Governor’s Office of Consumer Affairs, and a Special Assistant Attorney General.

He’s been specializing in franchise law for over 20 years and is well respected and known in the Atlanta franchise practice area.  He counts franchisors as clients from all over North America and has seen and had to deal with a lot of legal issues surrounding starting, running or buying a franchise.

It’s not a trivial issue, the going fine for each offer you make (remember the 10,000 emails you sent out?) is in the $10,000 plus each range… so it’s not something you want to learn about when you get a “dear felon” letter in the mail from the FTC…

A good franchise attorney can help you structure your concept to avoid the tripwires and consult with you to give you to plusses and minuses of being a franchise vs. a license arrangement. There are definite advantages to being considered a franchise vs. licensing so don’t automatically think it’s not a good solution. With a lot of sketchy advice about this subject alone, it’s worth talking with a pro when you are thinking “I’ll franchise my business.”

As a franchise buyer, you need to have a specialist in franchise law on your team who can advise you and help protect your interests and your family attorney is seldom expert in this legal specialty. Finding and developing talent in the franchise industry is very different from the traditional corporate world. Franchisors have to find the right talent to build the business and maintain the brand. Bill Williams is a Franchise Advisor who works with Franchisors to help them find the right talent for their organization. He began his career as an officer in the United States Army where he served for several years and is a Vietnam veteran.   For more than 25 years, he was an executive with technology companies, responsible for training, support, operations and IT.

After experiencing “his final corporate reorganization,” he became an adjunct career consultant with Right Management Associates, the firm who provided his outsourcing services and realized he is, at heart, an entrepreneur.

It was there that he discovered his passion to help others discover their full potential. “As a consultant, I helped them get past the anger and shock of being fired and see this as one of the greatest opportunities of their lives,” he says. “Often, they chose to ‘hire themselves’ and start their own businesses.”

Bill also had aspirations to be his own boss. He wanted to run a business that capitalized on his military and corporate experiences to help others realize their dreams. Research showed that the structure and track record of franchise businesses increased an owner’s success rate.

On today’s show we launched our “Inside Safety” series, and shined the spotlight on Fisher & Phillips Partner, Ed Foulke.

Prior to joining Fisher & Phillips, Mr. Foulke served as Assistant Secretary of Labor for Occupational Safety and Health.

Named by President George W. Bush to head OSHA, he served from April 2006 to November 2008.  During his tenure at OSHA, workplace injury, illness and fatality rates dropped to their lowest levels in recorded history. For more than 30 years, Ed has worked in the labor and employment area, focusing on occupational safety and health issues, workplace violence risk assessment and prevention, whistleblower protection, and accident and fatality prevention.
